Terms of Service

These are the terms that apply when you use LitMarker. They are written in plain English because most of our users are students, but they are a contract, so please read them.

1. Who we are

LitMarker (litmarker.io) is run by Samy Adel, a sole trader trading as “LitMarker” (“we”, “us”). LitMarker is not a registered company. If the business incorporates in future, these terms will be re-issued naming the company and we will tell you.

LitMarker is not affiliated with, or endorsed by, AQA, Edexcel (Pearson) or Eduqas, or any other exam board. We use board names only to identify which specification an essay is marked against.

2. Agreeing to these terms

These terms are a contract between you and us. You accept them when you tick the acceptance box at signup (we record when you accepted and which version), and by using LitMarker. If you do not agree with them, do not use LitMarker.

Our Privacy Policy explains how we handle your information and forms part of your agreement with us. Both documents are written in plain English because most of our users are students, and you should be able to understand what you are agreeing to.

3. What LitMarker is

LitMarker is a web app that gives AI-generated marking and study feedback for UK GCSE English Literature, English Language and History (AQA, Edexcel and Eduqas specifications). It includes:

  • Essay marking: paste, type, upload or photograph an essay (handwriting is read automatically) and receive mark-scheme-based feedback, an estimated mark and an assessment-objective (AO) breakdown;
  • Model answers: AI-generated exemplar answers, unlocked after a question has been marked;
  • Smart Improvements: AI-suggested rewrites of your own sentences;
  • LitBot: an AI study chatbot with access to your essay and feedback;
  • Question bank and revision tools, plus PDF report export; and
  • Class view: an optional, consent-based dashboard that lets a teacher you connect with see your essays, marks and feedback (see section 17).

4. Marks are AI-generated estimates

Every mark, grade, AO score, piece of feedback and model answer LitMarker produces is generated by AI. They are estimates for study purposes only. They are not official marks or grades, not predictions of your exam results, and not endorsed by AQA, Edexcel, Eduqas or any exam board or school.

AI marking will sometimes differ, sometimes significantly, from the mark a trained examiner would give the same essay. Treat LitMarker as a study aid alongside your teacher’s guidance, not as a substitute for it, and do not make important decisions based on an estimated mark alone.

We do not guarantee any grade, mark improvement or exam outcome.

5. Who can use LitMarker

  • You must be 13 or over. Every signup requires you to actively confirm this; we record your confirmation. If we learn an account belongs to someone under 13, we will close it and delete its data.
  • You must verify your email address before using the app, and the details you give us must be accurate.
  • LitMarker is designed for UK GCSE students and UK teachers.

If you are under 18

You can use the free plan yourself, provided you are 13 or over. Before buying a subscription, you should get a parent or guardian’s permission, and the payment card used must be one its owner has allowed you to use. We encourage parents and guardians to read these terms and our Privacy Policy, and they can contact us at hello@litmarker.io about any subscription or account held by their child.

6. Your account

  • Your account is personal to you. Do not share your login details or let anyone else use your account, and keep your password safe.
  • One account per person. Creating extra accounts to get around usage limits is not allowed.
  • You are responsible for activity on your account. If you think someone else has accessed it, tell us at hello@litmarker.io.
  • Teacher accounts are created by us directly (there is no self-serve teacher signup) and must not be used as student accounts, or vice versa.

7. The free plan

The free plan currently includes:

  • 1 essay marking per rolling 7 days;
  • 10 LitBot messages per week;
  • 3 Smart Improvements in total per account;
  • Model answers and PDF reports are Pro-only.

These allowances are what you are entitled to under these terms, whether or not the app technically blocks you at the limit in every case; we may enforce them technically at any time. We may change free-plan allowances or temporarily pause free marking. The free plan is provided as-is and is not guaranteed to stay the same.

8. LitMarker Pro: plans and prices

There is one paid tier, LitMarker Pro, available as an auto-renewing subscription. Current prices:

  • All prices are in pounds sterling (GBP) and are inclusive of any applicable taxes. LitMarker is not currently VAT-registered, so no VAT is added to the prices shown.
  • Payment is by card only, processed by Stripe through its secure checkout. We never see or store your card details. There are no free trials.
  • Promotional discount codes may be available for monthly and yearly plans from time to time.
  • If you subscribed in the past at a different price, your existing price continues to apply until changed under section 12.
  • Pro includes “unlimited” essay marking subject to the fair-use limit in section 13, plus model answers, Smart Improvements, LitBot chat, PDF reports and priority support. Pro marking uses our most capable AI model; free-plan marking uses a smaller, faster model.

9. Payment and auto-renewal

  • Your subscription renews automatically at the end of each billing period (weekly, monthly or yearly) and your card is charged, until you cancel.
  • You can switch plans in the app at any time. The change takes effect immediately with a prorated charge, which is shown to you and confirmed before you pay.
  • If a renewal payment fails, you keep your Pro features while Stripe retries the payment, and we will email you. If payment cannot be collected, your subscription ends and your account returns to the free plan.

10. Cancelling your subscription

  • You can cancel at any time from your billing settings in the app (Settings (gear icon), then Manage Subscription).
  • Cancellation takes effect at the end of your current billing period. You keep Pro access until then, and you will not be charged again.
  • You can reactivate a scheduled cancellation at any time before your period ends.
  • The cancellation flow may offer you a one-time discount to stay. Accepting it is optional.

11. Refunds and cancellations

This section sets out when you can get your money back. It reflects your rights under the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015, and nothing in it removes a right the law gives you.

Change of mind (your 14-day cooling-off right)

  • If you subscribe and change your mind, you can ask for a full refund within 14 days of subscribing, provided you have not started using the Pro features.
  • Your subscription gives you immediate access. At checkout you agree that your service starts straight away, and you acknowledge that once you start using the Pro features, the 14-day change-of-mind refund no longer applies.
  • To use this right, email hello@litmarker.io within 14 days of subscribing. You do not have to give a reason.
  • The cooling-off right applies to your initial purchase, not to each automatic renewal. You can cancel future renewals at any time under section 10.

Faulty or misdescribed service

If LitMarker Pro is faulty, not as described, or not of satisfactory quality, the Consumer Rights Act 2015 entitles you to remedies that can include a repair, a price reduction or a refund (see section 21). These rights do not depend on the 14-day window and cannot be removed by these terms.

Cancellation and part-used periods

You can cancel at any time (see section 10). Cancellation stops future renewals and takes effect at the end of your current paid period. We do not refund the remainder of a period you have already paid for, unless one of the statutory rights above applies or these terms say otherwise (for example sections 18 and 19).

12. Changes to prices and plans

We may change our prices or what is included in each plan. If a change affects an existing subscription:

  • we will email you at least 30 days before the new price takes effect; and
  • you can cancel before it applies. If you do, you pay nothing more and keep access until the end of your paid period.

A price change never applies retroactively to time you have already paid for.

13. Fair use and limits

  • Pro’s “unlimited” essay marking is subject to a fair use policy of around 20 essays per rolling 7 days. If you reach it while studying normally, email hello@litmarker.io and we will review and reset it.
  • We may adjust fair-use limits from time to time to keep the service sustainable; we will keep this page up to date.
  • Teacher assignment marking is subject to a monthly allowance per teacher, designed as cost protection rather than a practical ceiling.
  • Limits may be enforced technically, by policy, or both.

14. Acceptable use and academic integrity

Feedback, model answers and Smart Improvements are study aids that show you what stronger writing looks like. Do not submit AI-generated or AI-rewritten text as your own work in coursework, controlled assessments, exams or anything else that is assessed. Your school’s and exam board’s rules on AI use and plagiarism apply to you, and you are responsible for complying with them.

When using LitMarker you must not:

  • submit someone else’s work as your own, or work you do not have the right to submit;
  • share your account, or create multiple accounts to get around usage limits;
  • submit unlawful, abusive or harmful content, or misuse LitBot;
  • scrape, copy or bulk-download the question bank or any other part of the service;
  • reverse-engineer the service or attempt to extract our prompts, mark-scheme templates or grade tables;
  • resell or commercially exploit access to LitMarker;
  • interfere with the service’s operation or try to bypass its security or limits.

If you break these rules we may warn you, suspend your account, or in serious cases terminate it (see section 19).

15. Your essays and your content

You own your essays and everything you write on LitMarker. We claim no ownership of your work, and we will not publish it, sell it, or use it for marketing.

So that the service can work, you give us a limited licence to host, store and process your content, to send it to the AI providers that power marking, model answers and handwriting recognition (see our Privacy Policy for exactly who receives what), to display it back to you, and to share it with a teacher only if you have connected with them through the class view. That licence exists solely to provide the service to you. When you delete an essay, or your account is deleted, the licence ends for that content.

AI outputs

You may use the feedback, estimated marks, model answers and suggested rewrites for your own personal study and revision. You must not resell or republish them, present AI-generated text as your own assessed work (section 14), or present estimated marks as official results.

16. Our content and intellectual property

The LitMarker software, branding, prompts, mark-scheme templates, grade-boundary tables, question bank and revision materials belong to us or our licensors. You may use them within the app for your personal study, and not otherwise.

The question bank includes extracts from published literary works and questions in the style of past exam papers. Those works and the exam boards’ specifications belong to their respective owners; we reference exam boards only to identify specifications, and no exam board endorses or is affiliated with LitMarker.

17. Teachers and the class view

For students

  • Joining a teacher’s class is optional and happens only after you actively consent on a screen that explains exactly what the teacher will see, including essays written before you joined and personal (non-assignment) essays. A teacher cannot see any of your work before you consent.
  • You can disconnect a teacher at any time in Settings; their access ends immediately. They keep the gradebook records already created (your name and marks for submitted assignments), but not your essays.
  • While connected, you get Pro free. That ends automatically when the connection ends: you are not charged, you return to the free plan.
  • A teacher can never see your LitBot chats, private notes, email address or payment details.

For teachers

Teacher accounts are provisioned by us individually. As a teacher you must: use student information only to teach, give feedback and track progress for your class; keep it confidential; not share it with anyone who does not need it for that purpose; and comply with your school’s policies and data protection law. Each assignment marking counts against your monthly allowance. We may suspend teacher accounts that breach these obligations. A fuller teacher agreement may be introduced; we will notify teachers if so.

18. Availability and changes to the service

  • LitMarker is provided on an “as available” basis. It depends on third-party providers (hosting, AI models, payments), and like any online service it may occasionally be slow, interrupted or unavailable. We do not offer an uptime guarantee.
  • We may change, improve or withdraw features, change the AI models we use, and adjust usage limits over time.
  • If we make a change that significantly reduces what you get on a paid plan, you can cancel and, if you have paid for time you will no longer receive, we will refund the unused part.

19. Ending your account

  • By you: you can stop using LitMarker at any time. To delete your account and data, email privacy@litmarker.io; see our Privacy Policy for how deletion works.
  • By us: we may suspend or terminate your account if you seriously or repeatedly break these terms, use the service unlawfully, or put the service or other users at risk. Where reasonable, we will warn you first.
  • If we terminate a paid account other than for a breach of these terms, for example because we withdraw the service, we will refund the unused part of your subscription.

20. Our responsibility to you

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that UK law does not allow us to exclude, including your statutory rights as a consumer (section 21).

Subject to that:

  • We provide LitMarker with reasonable care and skill, but we are not responsible for your exam results or for decisions made in reliance on AI-generated estimates, which section 4 explains are estimates only;
  • we are not responsible for losses caused by events outside our reasonable control, or by your use of the service in breach of these terms;
  • our total liability to you is limited to the amount you paid us in the 6 months before the event giving rise to the claim.

21. Your statutory rights

As a UK consumer you have legal rights that these terms do not change. In particular, under the Consumer Rights Act 2015, digital content must be as described, fit for purpose and of satisfactory quality. If it is not, you may be entitled to a repair, a replacement or a price reduction, and if our digital content damages your device or other digital content through our lack of reasonable care, you may be entitled to compensation. Advice about your rights is available from Citizens Advice.

22. Governing law and disputes

These terms are governed by the law of England and Wales. If something goes wrong, contact us first at hello@litmarker.io and we will try to resolve it with you. Complaints about how we handle your personal data can also be made to the Information Commissioner’s Office (ICO) at ico.org.uk/make-a-complaint (see our Privacy Policy).

If we cannot resolve it, you can bring a claim in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. We do not require arbitration; nothing in these terms takes away your right to go to court or any other right you have as a consumer.

23. Changes to these terms

These terms replace all previous versions. When we change them, we update the “Last updated” date at the top. If we make a significant change, we will tell you in the app, for example by asking you to review and accept the updated terms before you continue, and price changes follow section 12. If you do not agree with a change, you can stop using LitMarker and cancel any subscription.

Other important terms

  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we do not enforce a term straight away, we can still enforce it later.
  • We may transfer this agreement to a company we incorporate to run LitMarker. Your rights will not be affected, and we will tell you if this happens.
